Technicality has been recognized as a bane to effective adjudication. Apart from its potency for eroding justice, it is capable of causing disenchantment amongst the populace especially in cases where public interest is at stake; for example, corruption cases. In Nigeria and all over the world, there is a consensus amongst opinion leaders, public commentators and politicians that corruption has debilitating effects on the economy of nations.
The Nigerian Correctional Service Act (NCSA) was passed in 2019 as part of institutional reforms in the Nigerian Prisons Service. The Prisons Act was therefore repealed by the NCSA and the Nigerian Prisons Service was renamed the Nigerian Correctional Service.
The doctrine of corporate personality was established in the case of Salomon v. Salomon & Co. Ltd (1897) A.C. 22. In that case, it was established that a company is essentially a legal person separate from its directors, officers and shareholders. Therefore, the rights and liabilities of the company are different from the right and liabilities of the officers and agents of the company.
The current asset declaration regime for public officers is based on the provisions of the 1999 Constitution. Section 173 of the 1999 Constitution establishes the Code of Conduct Bureau with one of its functions being to receive asset declarations from public officers.
